Easements

Electricity and telecommunication easements are really important as they allow us to convey electricity and telecommunications on, under or over private land without interruption to our network.

An easement gives people or organisations the right to access and use your property in specific situations for a limited purpose. The right is agreed to and recorded in an easement instrument between the landowner and other party, and registered against the propery's title. 

An easement does not confer ownership of the land - simply the right to use part of the land.

Electricity and telecommunication easements allow us to convey electricity and telecommunications on, under or over private land without interruption to our network.  They grant us the legal right to use, replace, add to and maintain the reticulation within the easement facility.

Electricity reticulation installed before 1 January 1993 have statutory rights under the Electricity Act 1992
and don't require an easement.

The route of any new electricity and/or telecommunication reticulation is surveyed and shown on a plan prepared by a surveyor. Once approved by us, the plan is deposited with Land Information NZ by the surveyor.

A legal document called an easement instrument is prepared and signed by both the Grantor (burdened party) and the Grantee (benefitting party). The easement instrument is then registered on the record of title of the land by a solicitor.
